The retail industry is a difficult sector. It requires constant interaction with the general consumer public – a group that is often demanding, impatient and in a hurry. In addition to being asked to please the public, retail workers are asked to sell products, hit quotas, understand the product lines and work long shifts. Now, with the pressure of e-commerce competition, managers in the retail settings are pressuring sales associates in unimaginable ways in an attempt to win customers at the brick and mortar stores. Too often we find that employers fail to recognize the inherent difficulties and the stress of the positions and fail to create an environment that takes into account the inherent stress. They also fail to employ managers and supervisors who treat workers in humane and fair ways and allow hostile work environments to go unchecked.
We routinely represent retail workers in dealing with hostile work environments and discriminatory practices based on disabilities and failure to make reasonable accommodations. We also often hear of discriminatory practices based upon race, religion, sex, age and sexual orientation. We also observe that workers in this industry are often made to work through unpaid ‘lunch breaks’ because things get ‘too busy’. That is wholly improper and is wage theft. If you are working, you have an absolute right to be paid!
While most people do not want to have to take action against their employer, it always makes sense to know your rights and to become educated as to whether the things you are experiencing are improper.
