  • The food service industry is a unique place to work.  It provides a great way to make money in a fun and social environment.  Employers, however, often provide an environment that attracts sexual misconduct, inappropriate behavior and environments where drug and alcohol abuse can enter the workplace.  We often observe owners and managers who are unsophisticated or attempt to take ‘short cuts’ that violate the law.  This includes wage law violations, such as attempting to pay workers lower ‘server’ rates even when they are required to perform ‘non-server’ functions for which they will not receive gratuities; improper policies as to ‘tip pooling’; and failure to pay overtime. Too often we find that employers fail to recognize the inherent difficulties of the
    positions and environments, fail to foster safe working conditions, fail to employ managers and supervisors who treat workers fairly, and allow hostile work environments to go unchecked.
  • We routinely represent workers in the food service industry in sexual misconduct cases and also in cases that arise from  discriminatory practices based on disabilities and failure to make reasonable accommodations. We also often hear of discriminatory practices based upon race, religion, sex, age and sexual orientation.  We further routinely pursue cases related to wage, tip and overtime issues.
